CHARLESTON — A  woman claims that her husband died because of the negligence of a transportation provider.

Robin Jean Harris, individually and as executor of the estate of Ronald Edward Harris, filed a complaint in Kanawha Circuit Court against the Putnam County Aging Program and Johnny "Doe" (last name unknown).

According to the complaint, on June 12, 2018, when Mr. Harris was being transported by the Putnam County Aging Program, Doe put a lap belt on him rather than an over-the-shoulder seat belt harness. When Doe slammed on the brakes at a light, Mr. Harris was caused to fall face first. He was taken to the hospital for treatment but died six days later.

The defendants are accused of negligence, reckless driving, negligent transportation of a disabled individual and wrongful death.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. She is represented by Richard E. Holtzapfel of Holtzapfel Law Offices PLLC in Hurricane.

The case has been assigned to Judge Jennifer F. Bailey.
