CHARLESTON — An LLC claims a $100,000 refundable deposit was never returned.
Blackjewel LLC filed a complaint in Kanawha Circuit Court against Nations Equipment Finance LLC, Matthew Lightfoot and Randy Hicks.
According to the complaint, on Aug. 30, 2018, the defendants reached out to Blackjewel to seek a finance agreement with it. The parties signed an agreement on Sept. 4, 2018, and Blackjewel wired $100,000 to the defendants for associated costs.
The defendants, however, informed Blackjewel that they would not be returning the money despite it being fully refundable to begin with. Blackjewel made demands to the defendants to return the money but they never did.
The defendants are accused of negligence, unjust enrichment and conversion.
The plaintiff is seeking all reasonable sums due, attorney fees and court costs. It is represented by Eric T. Frye in Milton.
The case has been assigned to Judge Tod J. Kaufman.
