Trucking company says it is owed more than $71,000 on a rebate

POINT PLEASANT — A trucking company is seeking damages, claiming it was never paid a rebate it is owed.

Carroll Farms Trucking LLC filed a complaint in Mason Circuit Court against Mid South Carbon Corporation.

According to the complaint, on April 22, 2014, when Carroll Farms Trucking was in a contractual agreement with Mid South Carbon for the shipment of goods, the defendant was obligated to pay Carroll Farms Trucking $71,674.48 for rebate but has not, despite amicable demand.

The defendant is accused of breach of contract and sums due.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. It is represented by Donald R. Capper of Proctorville, Ohio.

The case has been assigned to Judge R. Craig Tatterson.
