Couple claims negligent truck driver rear-ended their vehicle

HUNTINGTON — A couple is seeking damages after a truck driver allegedly struck the rear end of their vehicle.

James L. Sullivan and Tonia Sullivan filed a complaint in Mason Circuit Court against Putnam Transport LLC and Lawrence Michael Buss.

According to the complaint, on Oct. 10, 2018 the plaintiff was traveling on State Route 42 in Mason County. The claims states the defendant was driving in the course of his employment for Putnam Transport when he failed to stop in a timely manner and crashed into the rear of the plaintiff's vehicle.

The defendant is accused of negligence and reckless driving.

The case has been removed to the U.S. District Court for the Southern District of West Virginia's Huntington Division and has been assigned to Judge Thomas Johnston.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Robert Massie of Nelson Mullins Riley & Scarborough LLP in Huntington.
