Couple claims Marshall County officials damaged their property while performing sewer work

MOUNDSVILLE — A couple claims their property was damaged by a company doing sewer work.

Thomas D. and Pamela D. Harris filed a complaint in Marshall Circuit Court against MIke Enyart & Sons Inc. and E.I. Robinson Engineering Co.

According to the complaint, on June 2, 2017 the defendant entered into an agreement with the Marshall County Sewerage District to extend service to the plaintiffs' property. The suit states the plaintiffs' property was trespassed on and their trees and foliage were cleared to make room for the defendants' operations, which the plaintiffs never agreed to. The plaintiffs' home was allegedly damaged during the process.

The defendant is accused of negligence.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Andrea Poling of Berry, Kessler, Crutchfield, Taylor & Gordon in Moundsville.

The case has been assigned to Judge Jeffrey Cramer.
