Wheeling Island Gaming is accused of negligence leading to patron's injury

WHEELING — A couple is seeking damages, claiming that a negligent casino employee caused injury to a woman.

Charles A. and Rose M. Dawson filed a complaint in Ohio Circuit Court against Wheeling Island Gaming Inc., Delaware North Gaming Inc., Delaware North Cos. Inc. and Jane Doe.

According to the complaint, the plaintiff is seeking damages for an incident that took place Feb. 9, 2017 when the plaintiff was at the defendant's for a dinner banquet. The suit states the defendant was negligent and entered through a door that was opening to a heavily trafficked hallway. The door swung and struck the plaintiff, allegedly knocking her to the ground.

The defendants are accused of negligence and vicarious liability.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Justin Wiater of Fitzsimmons Law Firm in Wheeling.

The case has been assigned to Judge Ronald Wilson.
