Allstate customer says she wasn't adequately compensated for storm damage to home

LOGAN — A woman alleges she was inadequately reimbursed by her insurance company following storm damge to her home.

Niwanta Rakes filed a complaint in Logan Circuit Court against Allstate Property and Casualty Insurance Co.

According to the complaint, the plaintiff is seeking damages for an incident that took place after Feb. 10, 2018, when her home was damaged by a falling tree during a storm. The plaintiff reported the incident to the insurer, but the plaintiff claims she was not adequately compensated for the damages to the property.

The defendant is accused of unfair trade practices, bad faith and breach of contract.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Robert Kuenzel of Kuenzel Law in Chapmanville.

The case has been assigned to Judge Eric O'Briant
