HUNTINGTON — A supply company is seeking more than $4,400 in sums due on an open account.
Whayne Supply Co. filed a complaint in Cabell Circuit Court against Holley Excavating Inc.
According to the complaint, the plaintiff is seeking damages for sums due on an open account. The suit states the defendant has failed to pay off an account balance of $4,431.38 plus interest. The plaintiff alleges defendant has failed to pay off the account despite amicable demand.
The defendant is accused of unjust enrichment.
The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by James Tomasik of Reisenfeld & Associates in Cincinnati.
The case has been assigned to Judge Christopher Chiles.
