Nurse claims Amedisys Home Health fired him following requests for medical leave

WINFIELD — A registered nurse is seeking damages, claiming that instead of his employer giving him time off for a health issue it terminated him.

James Eric Walker filed a complaint in Putnam Circuit Court against Amedisys West Virginia LLC, dba Amedisys Home Health of West Virginia.

According to the complaint, the plaintiff is seeking damages for an incident that took place when the plaintiff was employed by the defendant. The suit states that the plaintiff, who had worked for the defendant since on Sept. 15, 2014, was diagnosed with intractable headaches and requested time off on Sept. 20, 2016. The plaintiff's initial request was allowed, but when the plaintiff requested another leave of absence for health issues in December 2016 the request was denied. Following an approved, health-related leave of absence from Jan. 27 to Feb. 6, 2017, the lawsuit claims plaintiff was terminated on Feb. 9, 2017.

The defendant is accused of wrongful termination.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Jon Hoover of Hoover Law in Barboursville.

The case has been assigned to Judge Phillip Stowers.
