Tree trimmer claims he was told to leave safety of bucket, leading to fall from more than 40 feet

MOUNDSVILLE — A man is seeking damages, claiming he was injured when he was caused to fall from a tree during a tree-trimming job.

David S. Duvall filed a complaint in Marshall Circuit Court against Monster Tree Service of The Upper Ohio Valley Inc. and Monster Tree Service Inc.

According to the complaint, the plaintiff was employed by the defendant's tree-trimming company in November 2017. The suit states on Nov.17, 2017, the plaintiff was instructed to climb into a tree to trim limbs rather than stay in the bucket truck. The plaintiff alleges he was caused to fall 40-50 feet to the ground, resulting in life-threatening injuries.

The defendant is accused of negligence.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Christopher Turak of Gold Khourey & Turak in Moundsville.

The case has been assigned to Judge Jeffrey Cramer.
