Couple claims property was damaged by construction, landslide on adjacent lot

MOUNDSVILLE — A couple is seeking damages, claiming their property was damaged by construction taking place next to their property.

James Victor George and Leah Gross filed a complaint in Marshall Circuit Court against J.F. Allen Co. and John Does Corps. and/or individuals.

According to the complaint, in April 2018 the defendants created a road on the side of the hill next to the plaintiff's property at 1568 Frontage Drive. The suit claims that a piece of ridge collapsed and the plaintiff's property was damaged due to a subsequent landslide.

The defendant is accused of negligence.

The plaintiff is seeking all reasonable sums due, attorney's fees and court costs. The plaintiff is represented by David Jividen of the Jividen Law Offices in Wheeling.

The case has been assigned to Judge Jeffrey Cramer.
