Homeowners association accused of negligence that damaged Morgantown couple's property

MORGANTOWN — A couple claims their property was damaged due to the negligence of a property management association.

Paul and Debra Laskody filed a complaint in Monongalia Circuit Court against Baker's Ridge Manor Homeowner's Association.

According to the complaint, the plaintiffs' property at 229 Poplar Drive began to show erosion of lateral support in April 2018. The plaintiffs allege they informed the defendant immediately, but that the defendant failed to remedy the situation that was caused by a defective stormwater management system, resulting in collapse of the plaintiffs' property.

The defendant is accused of negligence.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by James Wingfield of Gianola, Barnum, Bechtel & Jecklin in Morgantown.

The case has been assigned to Judge Russell Clawges Jr.
