Policyholder claims Liberty Mutual failed to fully compensate him for fire damage

ELKINS — A policyholder is seeking damages, claiming his insurance company failed to fully reimburse him following a fire.

Carlton White filed a complaint in Randolph Circuit Court against Liberty Mutual Insurance Co. It later was removed to federal court.

According to the complaint, the plaintiff is seeking damages for an incident that took place after the plaintiff's property was damaged by a fire on Aug. 26, 2017. The suit states the plaintiff filed a claim with the defendant, but that the defendant has failed to reimburse the plaintiff for all of the damages suffered.

The defendant is accused of bad faith, breach of good faith and breach of contract.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Scott Curnutte in Elkins.
