Stanley Steemer accused of bilking customers out of deceptive fuel surcharges

CHARLESTON — A customer is filing a class-action lawsuit, claiming a floor cleaning company overcharged for fuel costs.

Ken Skiles, on behalf of himself and a class of West Virginia residents, filed a complaint in Kanawha Circuit Court against  Partners Too Inc., dba Stanley Steemer and Stanley Steemer International Inc., alleging breach of contract and unjust enrichment.

The plaintiff alleges they were billed a fuel surcharge by the defendant for commercial floor cleaning services. The defendants claim the surcharge is to cover the fuel used by the defendant. The term, however, is alleged to be misleading and a deceptive profit scheme as the defendants' "fuel surcharge" is allegedly not related to the costs of fuel used by the defendant.

The plaintiff is seeking a trial by jury, costs incurred for the case, and return of all improper amounts of money paid. The plaintiff is represented by Stuart Calwell, L. Dante diTrapano, and David Carriger of Calwel, Luce, diTrapano in Charleston.

The case has been assigned to Judge Carrie Webster.
