Woman files suit over fraud allegations against OneMain Financial over truck loan

KINGWOOD – A Preston County woman alleges a financial services company misrepresented an auto loan for the purchase of a truck.

Tabitha D. Johnson filed a complaint in Preston Circuit Court against OneMain Financial Services Inc. alleging fraud.

According to the complaint, the plaintiff leased a truck from Ally Financial in 2015 and OneMain provided a loan to pay off the vehicle. She alleges the defendant did not make a complete payoff, misrepresented the loan and took a security interest in the vehicle. She alleges she learned in 2017 when she went to refinance the loan through Wells Fargo that the defendant had not paid off the truck.

The plaintiff alleges Ally is demanding she pay an additional $21,624 to release the title to the vehicle and that the defendant has denied any wrongdoing.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. She is represented by Michael Nissim-Sabat and Jennifer S. Wagner of Mountain State Justice in Morgantown.

The case has been assigned to Judge Steven L. Shaffer.
