Truck driver alleges Dingess Lumber's unsafe worksite caused fall, shoulder injury

PHILIPPI – A Randolph County couple alleges that an unsafe worksite in Summersville resulted in the husband's shoulder injury.

Jeff Doyle and Phyllis Doyle filed a complaint in Barbour Circuit Court against Dingess Lumber Co. Inc.

According to the complaint, on Feb. 15, 2017, Jeff Doyle was employed as a truck driver by Done-It LLC hauling lumber for the defendant. The suit states the plaintiff was at a sawmill and lumberyard owned by the defendant near Summersville and fell while retrieving lumber because of a lack of a stable walking surface. He alleges he sustained permanent injuries to his shoulder that required surgery.

The plaintiffs allege the defendant negligently failed to maintain a safe workplace.

The plaintiffs are seeking all reasonable sums due, attorney fees and court costs. They are represented by James R. Fox of Fox Law Office in Hurricane.
