Woman files suit against Raleigh Center over brother-in-law's death

BECKLEY – A Princeton woman has filed a wrongful death suit against a Daniels facility after her late brother-in-law died as a result of a food bolus while under its care.

Sonya Gibson, administratrix of the estate of Jason E. Vanover, filed a complaint in Raleigh Circuit Court against 1631 Ritter Drive Operations LLC, doing business as Raleigh Center, and Genesis Healthcare LLC.

The suit states Vanover was a patient at the defendants' nursing home facility at 1631 Ritter Drive, Daniels, beginning on June 5, 2016. She alleges while there, he was not given appropriate care and was caused to suffer from aspiration, asphyxiation and accidental death as a result of food bolus on Feb. 25, 2017.

The defendants are accused of wrongful death and negligence.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Jeff D. Stewart, Andrew L. Paternostro and S. Andrew Stonestreet of Stewart Bell PLLC in Charleston.

The case has been assigned to Judge H. L. Kirkpatrick III.
