Son of former Logan Center patient files wrongful death suit over father's care

LOGAN – A Kentucky man alleges a Logan nursing facility failed to provide a safe environment for his late father and has filed a wrongful death suit.

James D. Buskirk, executor of the estate of James C. Buskirk, filed a complaint in Logan Circuit Court against Three Mile Curve Operations LLC, doing business as Logan Center, and Genesis Healthcare LLC.

The suit states James C. Buskirk was a patient at the defendant's facility located at 55 LMMH Center Road, Logan beginning on March 27, 2018. 

The plaintiff alleges the defendants were negligent in their duties and failed to provide the appropriate level of care to James and caused James to suffer from infection and catheter-related hypospadias, urinary tract infection and kidney injury. The plaintiff alleges the defendants failed to provide a safe environment, adequate supervision and safety devices and their negligence caused or contributed to the decedent's death on June 22, 2018.

The defendants are accused of wrongful death, negligence and reckless misconduct.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Jeff D. Stewart, Andrew L. Paternostro S. Andrew Stonestreet of Stewart Bell PLLC in Charleston.

The case has been assigned to Judge Eric H. O'Briant.
