Couple sues apartment owner, landlord following fall down flight of stairs

HUNTINGTON — A couple is suing the owner of an apartment after they were both caused to fall, allegedly due to the lack of handrail on a staircase.

Jeffrey C. Hall and Shirley M. Hall filed a complaint in Cabell Circuit Court against McGinnis Land Co. Inc. and Sunny Gail Stowers.

The suit states the plaintiff entered into a lease agreement on June 11, 2004 with the defendant and continued to rent Apartment No. 4. The plaintiff informed the defendant there was a handrail missing on the second floor, but the defendant failed to make any changes. On several occasions, the plaintiffs were caused to be injured on the stairs including on Jan. 16, 2019, when plaintiff Shirley Hall fell down the flight of stairs.

The defendant is accused of negligence, breach of implied warranty.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs and a trial by jury. The plaintiff is represented by Scott Segal and Jason Foster of The Segal Law Firm in Charleston.

The case has been assigned to Judge Paul Ferrell.
