NEW CUMBERLAND – An estate representative has filed suit against a Weirton nursing facility over allegations its failure to implement safeguards contributed to the death of a resident.
Louann Molchan, as executrix of the estate of Mary Alice Rexroad, filed a complaint in Hancock Circuit Court against Serra Retirement Center Inc. and Weirton Geriatric Center Inc.
The suit states Rexroad was a resident of the defendants' Weirton Geriatric Center from Jan. 25, 2017, through March 13, 2018. The plaintiff alleges Rexroad was not given the proper care to prevent her from falling from her chair, striking her neck and causing a fracture of her cervical vertebra. The suit states the fall led to her death on March 13, 2018.
The defendants are accused of negligence and breach in the standard of care.
The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Jonathan R. Mani and Damon L. Ellis of Mani, Ellis & Layne in Charleston.
The case has been assigned to Judge Jason A. Cuomo.
