Putnam County man alleges he is owed $12,000 for purchase agreement

WINFIELD – A Putnam County man is suing a Kanawha County real estate company and an individual claiming that he is owed $12,000 in sums due.

Larry Holman filed a complaint in Putnam Circuit Court against Isaac Noyes "Quintie" Smith V, Realcorp LLC alleging breach of contract.

The suit states that the plaintiff and the defendants were parties in a sale and purchase of membership agreement and that the plaintiff performed his obligations under the contract. He alleges Smith breached the contract by failing or refusing to pay him the full purchase price of his entire membership in Realcorp, and Realcorp breached the contract by failing to refinance to remove him from all liability obligations.

The plaintiff alleges Smith owes him $12,000.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs and trial by jury. The plaintiff is represented by Eric S. Embree of Tyree, Embree and Associates PLLC in Hurricane.

The case has been assigned to Judge Phillip M. Stowers.
