Man alleges Capital Accounts harassed him with collection calls at work

CHARLESTON – A Fayette County man is suing a debt collection agency over allegations it harassed him with the collection of an alleged debt.

Wesley Waddell filed a complaint in U.S. District Court for the Southern District of West Virginia against Capital Accounts LLC alleging violation of the Fair Debt Collection Practices Act and the West Virginia Consumer Credit and Protection Act.

The suit states that the defendant contacted the plaintiff at his place of employment to collect a debt allegedly owed to a dentist's office. The plaintiff alleges the debt is not legitimate and he does not owe the amount.

The plaintiff alleges he informed the defendant that he was not able to receive personal calls on his work phone during work hours and asked it to stop calling him. He alleges the defendant continued to call him at his place of employment.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs and trial by jury. The plaintiff is represented by Joshua A. Mize of Mize Law PLLC in Jupiter, Florida.
