BECKLEY – A Bradley man alleges a repossession company breached the peace when it repossessed his vehicle.
Christopher Ryan Quesenberry filed a complaint in Raleigh Circuit Court against Wells Fargo Dealer Services and F-5 Investigation Inc.
The suit states that on March 1, 2017, at 11:15 p.m., F-5 Investigation was attempting to repossess a vehicle that had been financed by Wells Fargo and was located at the plaintiff's home. He alleges F-5 Investigation's agents/employees "pounded" on his door, woke him up, and failed to identify themselves.
The plaintiff alleges F-5 employees started a verbal altercation, intimidated him and refused to tell him where they were taking his vehicle.
The plaintiff alleges Wells Fargo breached its duty by failing to ensure F-5 did not breach the peace when it repossessed the vehicle.
The plaintiff is seeking all reasonable sums due, attorney fees and court costs and trial by jury. The plaintiff is represented by Kyle G. Lusk, Matthew A. Bradford and Brandon L. Gray of Lusk & Bradford PLLC in Beckley.
The case has been assigned to Circuit Judge Andrew Dimlich.
