BECKLEY— A woman is suing her employer, alleging that she is owed overtime for more than eight years of work.
Telietha Smith filed a complaint in Raleigh Circuit Court against Dr. Mustafa Rahim, Beckley ARH Hospital and Raleigh General Hospital LLC.
The suit states the plaintiff was employed by the defendant and during her time of employment was not paid other wages or fringe benefits. The plaintiff claims she was entitled to overtime pay at $21 an hour for 20 hours a week that she worked for eight years. The total sums due the plaintiff is seeking are well over $120,000, as the plaintiff alleges she was regularly forced to work 60 hours a week. The defendant allegedly violated numerous laws through failing to pay the plaintiff for wages that were due.
The defendant is accused of violation of public policy, violation of the West Virginia Human Rights Act, and West Virginia WPCA violation.
The plaintiff is seeking all reasonable sums due, attorney fees and court costs and trial by jury. The plaintiff is represented by D. Adrian Hoosier II of Hoosier Law Firm in Charleston.
