POINT PLEASANT – A Letart dairy is alleged to have failed to pay a contract in full for the purchase of a skid steer.

Deere & Co. filed a complaint in Mason Circuit Court against Jamestown Dairy LLC and Travis Cullen alleging breach of contract.

The suit states that the plaintiff is the holder of a retail installment contract that was executed and delivered by the defendants on Jan. 12, 2016, for a used skid steer loader. The suit states the defendants defaulted on the loan and the plaintiff repossessed the equipment.

The plaintiff alleges $3,735.52 plus interest is still owed on the contract.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Arch W. Riley Jr. of Bernstein-Burkley P.C. in Wheeling.

The case has been assigned to Judge Richard Craig Tatterson.
