Consumer files suit against Ocwen Loan Servicing over unlawful fee allegations

BECKLEY – A Raleigh County man is suing a loan company alleging that the company made unfair representations threatening debt collection and fees.

Roger L. Cozort filed a complaint in U.S. District Court for the Southern District of West Virginia against Ocwen Loan Servicing LLC alleging unfair deb collection.

The suit states that the plaintiff obtained a residential home mortgage loan from GMAC Mortgage Corp. in 2006 for $149,428 and the loan was assigned, sold or transferred to the defendant. 

The plaintiff alleges the defendant "threatened" to asses and/or assessed unlawful default fees on the loan such as attorney's fees and inspection fees. The plaintiff alleges this was done through misleading representations when no foreclosure sale was held or scheduled.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs and trial by jury. The plaintiff is represented by Jason E. Causey of Bordas & Bordas PLLC in Wheeling.
