Consumer alleges Stephens Auto Center failed to repair issues with Chrysler

CHARLESTON – A Boone County man alleges a vehicle he purchased in 2017 has nonconformities that impair its use and is seeking a cancellation of the contract.

John Donohue filed a complaint in Kanawha Circuit Court against FCA US LLC and Boone Motor Sales Inc., doing business as Stephens Auto Center, alleging negligence, fraud and misrepresentation, unfair and deceptive acts or practices, breach of good faith, breach of warranty and breach of contract.

The suit states that the plaintiff entered into an agreement with Boone Motor Sales for the purchase of a 2016 Chrysler 200 on Aug. 11, 2017, and the vehicle came with warranties. The plaintiff alleges the vehicle did not conform to the warranties and the defendant did not make the necessary repairs to conform it to the warranties after a number of attempts.

The plaintiff is seeking a cancellation of the contract, all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Charles M. Love of The Love Law Firm PLLC in Charleston.

The case has been assigned to Judge Carrie L. Webster.
