Maelee Tree Service is accused of negligence in employee's death

CHARLESTON — An estate administrator is suing a tree-cutting company after a man died when a tree fell on him.

Aaron M. Hamilton, as administrator of the estate of Darby Glen Hamilton, filed a complaint in Kanawha Circuit Court against Maelee Tree Service LLC, Pierson Lumber Co. Inc., et al.

The suit states Darby Glen Hamilton was performing duties for Maelee Tree Service on Feb. 8, 2017 at 76 Hootowl Road in Clendenin. Darby Glen Hamilton allegedly was not provided with a safe workplace and was struck by a falling tree that kicked back and fell on him. Darby Glen Hamilton was caused to die as a result of Maelee Tree Service's alleged failure to properly train its employees.

The defendants are accused of negligence, negligent hiring, and deliberate intent.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Shannon Bland of Bland & Bland in Charleston.

The case has been assigned to Judge Carrie Webster.
