Landlord claims Whittington Fence Co. is 9 months behind on rent

CHARLESTON — A contracting company is suing a tenant, alleging it has not received rent for months.

Equity Contractors Inc. filed a complaint in Kanawha Circuit Court against Whittington Fence Co., Greg Whittington and Lori Whittington.

The suit states the plaintiff contracted with the defendant to rent space for business purposes at 427 Woodrum Lane on Sept. 1, 2017. The defendant was to begin renting on Oct. 1, 2017 with the monthly rent being $2,500. The plaintiff alleges the defendant has failed to make rental payments since June 2018.

The defendant is accused of promissory estoppel, unjust enrichment and breach of contract.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Travis Griffith of Griffith Law Center in Charleston.

The case has been assigned to Judge Tod Kaufman.
