Driver claims he was fired for taking a prescribed medication

CHARLESTON — A driver is suing his former employer, alleging he was terminated after a prescription drug showed up on an illicit drug screening.

Billy Don Fore Jr. filed a complaint in Kanawha Circuit Court against Bulk Transit Corp.

The suit states the plaintiff was employed by the defendant from Sept. 15, 2017 through Feb. 27, 2018. The plaintiff was injured on Feb. 6, 2018 while employed and sought medical care. The plaintiff had to submit a post-accident drug screening, which revealed oxymorphone metabolite. The plaintiff explained it was from a prescription he had to take, but the defendant, nonetheless, terminated the plaintiff.

The defendant is accused of violation of the Wage Payment & Collection Act and retaliatory discharge.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Michael Olivio of Olivio Law Firm in Charleston.

The case has been assigned to Judge Charles King.
