Couple sues Ford, claiming 2018 Explorer they purchased new is a lemon

CHARLESTON — A couple is suing Ford Motor Co., alleging they were sold a car in poor condition.

Michael and Crystal Godbey filed a complaint in Kanawha Circuit Court against Ford Motor Co. and Transportation Network V LLC.

The suit states the plaintiffs purchased a 2018 Ford Explorer from the defendant on May 16, 2018. While the vehicle came under warranty, after the plaintiffs purchased the car they began to notice issues with the vehicle. The plaintiffs have had to take the vehicle in for repair multiple times but it continues to fail to perform as advertised, and the defendant has failed to provide a comparable replacement vehicle to the plaintiff.

The defendant is accused of breach of duty of good faith, negligence, unfair and deceptive acts, and breach of warranty.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Kristina Thomas Whiteaker of The Grubb Law Group in Charleston.

The case has been assigned to Judge Jennifer Bailey.
