Ramsey's Excavating alleges it is owed more than $300,000 for reclamation work

SUMMERSVILLE – A Nicholas County business alleges it was not paid for reclamation work it performed on a property.

Michael Allen Ramsey, doing business as Ramsey's Excavating, filed a complaint in Nicholas Circuit Court against Southeastern Land LLC, Wright Management Co. LLC, Booth Energy Group and Fola Coal LLC.

The suit states that the plaintiff was hired by the defendants to perform reclamation work on a Nicholas County property in 2018. The plaintiff alleges the defendants have failed to pay the plaintiff for the services provided, totaling $316,836.60 owing to the plaintiff.

The defendants are accused of unjust enrichment and breach of contract.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. It is represented by Steven L. Thomas of Kay Casto & Chaney PLLC in Charleston.

The case has been assigned to Judge Stephen O. Callaghan.
