Goodwin Foot and Ankle Center patient alleges surgery caused pain, functional loss in toe

WHEELING – The patient of an Ohio County doctor alleges she was caused pain because of issues from a surgery.

Dottie A. Jaeger filed a complaint in Ohio Circuit Court against Joseph Goodwin D.P.M. and Goodwin Foot and Ankle Center PLLC alleging breach of the standard of care.

The suit states the defendant conducted surgery to place an implant in her right hallux prior to February 2017, the implant failed, and another surgery was done on Feb. 3, 2017.

The plaintiff alleges during the second surgery, the defendant deviated from the standard of care and failed to properly align two implants in the plaintiff's right first toe and failed to properly create a joint space within that toe. She alleges as a result, her toe was left in an improper condition and caused her pain and functional loss.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Anthony I. Werner and Joseph J. John of John & Werner Law Offices PLLC in Wheeling.

The case has been assigned to Judge Michael J. Olejasz.
