Means Lumber customer alleges ice in garage caused fall

BECKLEY – A Mount Hope man is suing a lumber company alleging that he was caused to slip and fall because of ice on the premises.

James Dalton filed a complaint in Raleigh Circuit Court against Means Lumber Co. alleging negligence.

The suit states that the plaintiff was a patron at the defendant's premises at 214 Sisson St. in Beckley on March 16, 2017. The plaintiff alleges he backed his truck into the garage to load lumber and when he stepped out, slipped and fell, hitting his head, neck and shoulder on the cement floor. The suit states he lost consciousness.

The plaintiff alleges a clear sheet of ice in the garage caused him to fall and no warning signs were in place.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Adam D. Taylor and Amanda J. Taylor of Taylor & Hinkle in Beckley.

The case has been assigned to Judge Andrew Dimlich.
