BECKLEY – A Raleigh County couple alleges a doctor's negligence in treating a fracture has caused the husband pain and injury.
Thomas B. Taylor Jr. and Tammy Taylor filed a complaint in Raleigh Circuit Court against George M. Charron, M.D. alleging negligence.
The suit states that Thomas Taylor presented to the emergency room at Raleigh General Hospital on June 25, 2017, with pain in his left shoulder. An X-ray of his shoulder was ordered and it showed a fracture of his proximal left humerus, the suit states, and he was instructed to follow up with Charron the next day.
The plaintiff alleges Charron told him to keep his arm in a sling and it would heal. The plaintiff returned on July 6, 2017, and July 17, 2017, and the fracture had not improved. The suit states on July 31, 2017, the plaintiff underwent an open reduction and internal fixation with a plate and screw.
Thomas Taylor alleges motion in his arm continued to decrease and on Dec. 13, 2017, he had to have a total shoulder replacement performed by a different doctor. He alleges he continues to need treatment and suffers from pain.
The plaintiffs allege Charron failed to appropriately perform surgery and failed to appropriately place the hardware during the surgery.
The plaintiffs are seeking all reasonable sums due, attorney fees and court costs. They are represented by Robert V. Berthold Jr. of Berthold Law Firm PLLC in Charleston.
The case has been assigned to Judge Robert Burnside Jr.
