Toll booth worker seeks damages from Penske, UPS and driver over collision

CHARLESTON – A toll booth worker has filed a suit against a tractor-trailer driver who collided with his booth last fall and trapped him inside.

John D. Terry Jr. filed a complaint in Kanawha Circuit Court against United Parcel Services Inc., Penske Leasing and Rental Co. and Phillip Aaron Ventura alleging negligence.

The suit states that on Nov. 16, 2018, the plaintiff was working in a toll booth near Chelyn on the West Virginia Turnpike. The suit states Ventura, who was operating a truck owned by Penske and a trailer owned by United Parcel Service, collided with the toll booth and trapped the plaintiff inside. The plaintiff alleges he was injured and expended large sums of money for medical treatment as a result of the collision.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs and a trial by jury. The plaintiff is represented by J. Michael Ranson of Ranson Law Offices in Charleston.

The case has been assigned to Judge Jennifer F. Bailey.
