Bilmar Limited Partnership alleges 7-11 abandoned St. Albans property without notice

CHARLESTON – A Kanawha County partnership alleges its convenience store property was abandoned without notice and damaged.

Bilmar Limited Partnership filed a complaint in Kanawha Circuit Court against 7-11 Inc., Antea Group, AECOM, Kevin Booten, Enviroprobe Integrated Solutions Inc. alleging breach of lease, negligence and conversion.

The suit states that the plaintiff has a lease with 7-11 Inc. for the defendant to operate a store in St. Albans.

The suit states that 7-11 abandoned the property in December 2018 without proper notice to the plaintiff and cut off the utilities, causing the water lines to freeze and damage the convenience store.

The plaintiff alleges 7-11 breached the lease by failing to provide proper maintenance and Booton and Enviroprobe were negligent in their removal of the storage tanks from the property. The plaintiff also alleges AECOM was negligence in its failure to properly clean up the property.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by John W. Alderman III of the Law Offices of John W. Alderman III in Charleston.
