Mother alleges child found a needle in the play area of South Charleston McDonald's

CHARLESTON – A Dunbar mother has filed a suit against the operator of a South Charleston McDonald's after her minor child allegedly found a used needled in the children's play area.

Courtney Monk, individually and as guardian of a minor B.J.M., filed a complaint in Kanawha Circuit Court against Coalfield Mac LLC, doing business as McDonald's Store 13488, alleging negligent infliction of emotional distress and negligence.

The suit states that the plaintiff and her minor child were customers at the defendant's restaurant on Mountaineer Boulevard on July 27, 2018. The suit states B.J.M. was playing in the children's play area and picked up a use hypodermic needle "apparently left by a previous customer."

The plaintiff alleges that the defendant failed to inspect and/or clean the children's area and knew or should have known about the used needle and its hazards.

The plaintiff alleges B.J.M. had to undergo blood testing to determine if she had contracted any communicable disease as a result of the incident.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs and a trial by jury. The plaintiff is represented by Shawn R. Romano of Romano & Associates PLLC in Charleston.

The case has been assigned to Judge Joanna Tabit.
