Shop-A-Minit Markets alleges 7-11 breached lease when it had tanks removed at property

CHARLESTON – The owner of a store in Nitro alleges 7-11 failed to keep the property in a good condition and is seeking damages.

Shop-A-Minit Markets Family Partnership filed a complaint in Kanawha Circuit Court against 7-11 Inc., Antea Group, AECOM and Enviroprobe Integrated Solutions Inc. alleging breach of lease and negligence.

The suit states that the plaintiff owns a convenience store in Nitro and with its purchase, received full assignment of the lease that was assigned to 7-11 to operate the store. The suit states 7-11 was required to maintain the property and keep the interior and exterior in good condition.

The plaintiff alleges 7-11 failed to keep the property in good condition and negligently had the gasoline tanks removed, crushing a sewer line that filled the subsurface of the premises. 

The plaintiff alleges Antea Group, AECOM and Enviroprobe Integrated Solutions Inc. were negligent in their removal of the tanks.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by John W. Alderman III of the Law Offices of John W. Alderman III in Charleston.

The case has been assigned to Judge Carrie Webster.
