Rite Aid accused of filing wrong prescription, which allegedly led to patient's death

CHARLESTON — A woman was allegedly caused to die due to an incorrectly filled prescription.

Patty A. Reed, as administratrix of the estate of Patricia L. Smith, filed a complaint in Kanawha Circuit Court against Walgreen Co., Rite Aid of West Virginia Inc., Rite Aid Headquarters Corp., and John Doe.

The suit states that on May 11, 2017, Smith went to a Rite Aid to fill a prescription for Januvia tablets, 25 mg. to take once a day orally. The defendant, however, allegedly gave Smith Impramine HCL 25 mg. Smith took the medication until July 9, 2017 and was caused to suffer adverse effects, such as falling. Smith died on Sept. 4, 2017, due to deterioration of condition attributed to the medication.

The defendant is accused of pharmaceutical malpractice and liability.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Michael Del Guidice of Ciccarello, Del Guidice & Lafon in Charleston.

The case has been assigned to Judge Joana Tabit.
