Woman files slip-and-fall lawsuit against Kroger

CHARLESTON — A woman is suing Kroger, alleging she fell because of a dangerous condition in the store.

Cheryl Dailey filed a complaint in Kanawha Circuit Court against Kroger Limited Partnership I, dba K029 Kroger/East Mid-Atlantic.

The suit states the plaintiff was a customer at the Kroger at 981 Dunbar Plaza in Dunbar on Feb. 11, 2018, when she was caused to slip and fall, striking her head and left elbow on the ground. The plaintiff was taken by ambulance to Thomas Memorial Hospital.

The defendant is accused of negligence.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Benjamin Adams of Calwell, Luce, DiTrapano PLLC in Charleston.

The case has been assigned to Judge Charles King.
