Property owners claims Columbia Gas Transmission violated terms of their agreement

MOUNDSVILLE — A couple is suing a pipeline company, alleging it violated their agreement.

Perry L. and Imogene Keaton filed a complaint in Marshall Circuit Court against Columbia Gas Transmission LLC.

The suit states the plaintiffs executed an amendment with the defendant as grantee on Nov. 30, 2012, that gave the defendant rights to construct, install, maintain and repair a pipeline transporting natural gas. The defendant was required to pay for damages its operations caused. The suit states that in August 2018, the Marshall County Coal Co. began longwall mining operations that required cutting down trees from the plaintiffs' property. The defendant has allegedly failed to reimburse the plaintiff for the timber cut from their property and has also failed to bury or remove the pipeline set on the plaintiff's property.

The defendant is accused of breach of contract.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Eric Gordon of Berry, Kessler, Crutchfield, Taylor & Gordon in Moundsville.
