Couple claims Ohio County Coal Co. has damaged their property

MOUNDSVILLE — A couple is suing a coal company, alleging its operations have damaged their property.

William E. and Sondtra Toland filed a complaint in Marshall Circuit Court against The Ohio County Coal Co.

The suit claims the plaintiffs are owners of two parcels of land and that the defendant began conducting operations on the plaintiffs' property in March 2017. The defendant's operations allegedly caused damages to the plaintiffs' property and the defendants have failed to either remedy the situation or compensate the plaintiffs for the alleged damages caused.

The defendant is accused of negligence, improper mining operation, and breach of contract.

The plaintiffs are seeking all reasonable sums due, attorney fees and court costs. The plaintiffs are represented by Eric Gordon of Berry, Kessler, Crutchfield, Taylor & Gordon in Moundsville.
