Son of man killed at Marshall County job site files wrongful death suit against Precision Pipeline, others

MOUNDSVILLE – The surviving son of a Texas man killed at a Marshall County job site has filed a wrongful death suit against the companies who owned, maintained, managed or operated the site.

Colt W. Sanders, administrator of the estate of Roy Benny Sanders Jr., filed a complaint in Marshall Circuit Court against Precision Pipeline LLC, Energy Transfer LP, ETP Legacy LP, Energy Transfer Partners GP LP, Energy Transfer Partners LLC alleging negligence, unsafe workplace and wrongful death.

The suit states that the plaintiff was driving on the defendants' work site in Marshall County on March 16, 2018, when the ground gave way and Sanders Jr. fell off of the side of hill. The suit states he was ejected from his vehicle and died as a result.

The plaintiff alleges the defendants failed to provide the decedent with a safe place to work, failed to provide proper safety equipment and failed to warn of the unsafe condition.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Clayton J. Fitzsimmons of Fitzsimmons Law Firm PLLC in Wheeling.
