Widow files suit against Ruby Memorial Hospital, others over husband's death

MORGANTOWN – The spouse of a late Mount Hope man has filed a suit against several physicians and medical facilities after he died a day after being discharged from the hospital.

Thu Thanh Elswick, individually and as administratrix of the estate of Norman Douglas Elswick, filed a complaint in Monongalia Circuit Court against West Virginia University Board of Governors; West Virginia University Medical Corp.; West Virginia University Hospitals Inc., doing business as J.W. Ruby Memorial Hospital; Jennifer Knight, M.D.; John Mourany, M.D.; and Kelsey Musgrove, M.D. alleging liability.

The suit states Knight performed an elective ileostomy reversal on Norman Douglas Elswick on March 17, 2017. The suit states he was discharged March 22, 2017, from J.W. Ruby Memorial Hospital and died the next day. The suit states an autopsy found he died from peritonitis and small intestine ischemia.

The plaintiff alleges Knight, Musgrove and Mourany deviated from the standard of care when they failed to test for internal bleeding.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Daniel P. Taylor of Dittmar, Taylor & Makricostas PLLC in Weirton.
