Walker Machinery files lawsuit seeking over $4,500 on open account

CHARLESTON — A machinery company is suing a client, alleging it was never paid for materials provided.

Cecil I. Walker Machinery Co. filed a complaint in Kanawha Circuit Court against 4M Excavating LLC.

The suit states the plaintiff entered into an agreement with the defendant on May 23, 2018. The suit alleges the plaintiff supplied goods to the defendant, but the defendant has failed to pay the plaintiff what it is owed, which totals $4,512.41.

The defendant is accused of failure to pay and unjust enrichment.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by James Tomasik of Reisenfeld & Associates LLC in Cincinnatti, Ohio.

The case has been assigned to Judge Tod Kaufman.
