Buyers allege home delivered by S&M Home Sales had defects

PRINCETON – A Fayetteville couple is suing a Princeton company over allegations a home they purchased was delivered with defects.

Leslie J. Pettry and John Pettry filed a complaint in Mercer Circuit Court against S&M Used Automobiles & Mobile Home Sales Inc., doing business as S&M Home Sales Inc., alleging negligence and other counts.

The suit states that on April 14, 2016, the plaintiffs contracted the defendant for the sale of a home. The suit states that the plaintiffs paid a balance of $30,000 on the total price of the home, which was $76,272, and the defendants were to deliver and set up the home on a lot in Fairdale.

The plaintiffs allege that despite the defendant's claim that the property would be properly assembled and have no damages, there were numerous defects with the property. These defects allegedly included stress cracks in the drywall, loose siding, crooked shingles and exposed openings in numerous places around the columns.

The plaintiffs are seeking an order rescinding the purchase of the home, attorney's fees and court costs. The plaintiffs are represented by Anthony M. Salvatore of Hewitt & Salvatore PLLC in Fayetteville.

The case has been assigned to Judge Derek C. Swope.
