RIPLEY – A Jackson County couple is seeking the release of a deed of trust on a property they own.
Robert L. Baker and Teresa A. Baker filed a complaint in Jackson Circuit Court against Rousseau Mortgage Corp.
The suit states that the plaintiffs are owners of a piece of real estate affected by a purported lien. The suit states a deed of trust was executed on the property in 1979 and in 1987, the deed was assigned to Commonwealth Mortgage Co. of America. In 1991, it was allegedly assigned to the defendant.
The plaintiffs allege they are "confident" the note secured by the deed of trust has been fully paid and satisfied and the original beneficiary failed to release it.
The plaintiffs are seeking a release of the deed of trust and any other relief as deemed appropriate. They are represented by Robert D. Fisher of Adams, Fisher & Chappell PLLC in Ripley.
The case has been assigned to Judge Lora Dyer.
