CHARLESTON – A Kanawha County man alleges he was hired by a St. Albans company and then did not work the hours he was promised per month at the time of his hiring.
Clifford H. Humphries filed a complaint in Kanawha Circuit Court against ZDS Design/Consulting Services and Todd Zachwieja alleging fraud.
The suit states that the plaintiff responded to a job posting by ZDS on ZipRecruiter. The plaintiff alleges was interviewed by Zachwieja and given a job in which the defendants guaranteed the plaintiff 80 hours of work per month at $35 per hour.
The suit states the plaintiff completed a project and then asked Zachwieja if he could contract his services to the contractor, but Zachwieja said that it would be a conflict of interest.
The plaintiff alleges on March 28, Zachwieja told him his services would not be needed until August despite being told he was to work 80 hours per month. The plaintiff alleges he was defrauded by the defendants.
The plaintiff is seeking $100,000 in punitive damages and $33,600 in compensation. The plaintiff is representing himself.
The case has been assigned to Judge Jennifer Bailey.
