BECKLEY — A coal company is being sued for allegedly failing to reimburse a trust fund as required by law.

R. Alexander Acosta and Carolyn King filed a complaint in Southern District of West Virginia against Rock N Roll Coal Co. Inc.

The suit states that a man, Mr. Johnson, was employed by the defendant from 1995-1998. The man filed a claim for benefits on April 2, 2010 and died on Jan. 17, 2013. The defendant allegedly has failed to pay the amount owed to the trust fund of the deceased man.

The defendant is accused of failure to reimburse a trust fund.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Dominique Senesi of the U.S. Department of Labor in Arlington, Virginia.
